2009 Spring Consignment Auction

Our next bi-annual Consignment Auction will be conducted on Saturday, April 25, 2009, beginning at 9:30 a.m. The auction will take place on our premises located 8 miles west of Rockford, IL on U.S. 20 (at the corner of Highway 20 and Conger Road). Some items have been consigned already and consignors are now beginning to bring their items to our lot. Photos of items that have arrived will be posted below beginning April 8, 2009. Be sure to check this page frequently for new photos as new photos will be posted daily up until auction day. Now is the time to call or stop by our place to consign your items. Consignments will be accepted until 5:00 p.m. Wednesday, April 22, 2009, but it's best to get your items here early so that prospective buyers can see them on this web site. Following are the general Auction Terms and Conditions and the Sale Bill. Due to certain circumstances we are unable to place all of the auction pictures on our website. However, we have over 500 items on our lot for sale!

Consignment Auction Terms and Conditions

1. Consignor's Representation: To the best of NITE's knowledge, the consignor is the true owner of each consigned item and each item is free and clear of all liens, encumbrances, or claims by any other persons.

2. Consignor's Risk of Loss: NITE is not responsible for loss or damage to any consigned item placed on NITE's the consignor until which time it is sold. Therefore, the consignors should maintain insurance against loss and damage until which time the item is sold.

3. Purchaser's Risk of Loss: Ownership of each item is immediately transferred to the purchaser at the moment the auctioneer announces "sold". Thereafter, purchaser is responsible for protecting the purchased item against loss or damage. NITE is not responsible for loss or damage to any sold item on NITE's property. Gate security will be provided by NITE on auction day.

4. NITE's Commission Rates for Auction Services: Sell  price of $0 to $250 charged at 20% rate ($10 minimum). Sell price of $250.01 and up charged at 8% rate ($500 maximum).

5. NO SALE Fee: NITE will charge a $50 no sale fee for each item that is not sold in the auction, payable before the item is removed by the consignor from NITE's property.

6. Price Protection: Consignors MUST "price protect" any consigned item if thy feel that it is necessary to do so. NITE IS NOT RESPONSIBLE FOR THE SALE PRICE OF ANY ITEM!

7. All Titled Consignments: No vehicle that requires a title will be sold unless the title is in NITE's possession prior to the auction. Buyers of a titled vehicle listed by a registered dealer must also pay title fee, license fee, doc fee, and sales tax to that registered dealer. Titled dealer items will be labeled as such on auction day.

8. Payments to Consignors: Commission expense will be deducted from the sale price of each item and the balance due the consignor will be mailed by NITE within a maximum of two weeks from the date of the auction.

9. Handling of "Hay Rack Item": All "hay rack" items are "absolute sale" items. All "hay rack" items must be unloaded by the consignor onto a platform provided by NITE. A group of "hay rack items" will be tagged as one item as it relates to commission payment, even though some items in the group may be sold separately (at NITE's discretion).
